Job Description

Corporate Tax Audit (local and international)

Tax Audit Resolution with the Inland Revenue Board (“IRB”)

  • Present during the tax field audit visit to assist the Company in liaising with the IRB officers.
  • Provide tax advice to the Company in dealing with the IRB’s queries during the tax field audit visit.
  • Coordinate with the Company and the IRB and providing necessary documents and information to the IRB.
  • Review the tax related documentation relating to the case.
  • Draft and review appeal letters to justify the Company's stand on tax treatment and apply for waiver or reduction in tax penalty.
  • Assist the Company to formulate strategy towards finalisation of the tax audit with the IRB and exploring alternative tax dispute resolution avenues.
  • Assist the Company in outlining the optimal defence strategies with the aim of finalising the tax audit favourably.
  • Support the Company’s management in liaising and negotiating with the IRB.
  • Engage in frequent meetings and liaison with the Company and the tax authority towards amicable resolution of the tax audit.

Appeal Against Assessment i.e. Appeal before Special Commissioners of Income Tax, High Court, Court of Appeal and Federal Court (if applicable)

  • If the tax dispute cannot be resolved with the IRB, to assist the legal counsel appointed by the Group in preparing for the appeal.
  • Coordinate with the company to provide necessary documents and information to the legal counsel.
  • Discuss and meeting with the legal counsel or the Company, as and when necessary.
  • Support the Company’s management in liaising with the legal counsel.

Tax Advisory (local and international)

To conduct research and producing reports or input (i.e. presentation slides / memo / Board & Committee papers / emails) in the following areas:-

  • Merger and Acquisition / Divestment / Corporate Restructuring and Reorganisation;
  • Special Projects; and
  • Tax Compliance Related Advisory.

Work also include:

  • Do research, obtain/prepare supporting documents, attend meetings with Business Unit (“BU”);
  • Prepare and review due diligence reports;
  • Assess tax implications for the proposed transaction and identify tax issues of potential corporate / financing structures (i.e.  potential holding company, repatriation of profits, exit strategies, withholding tax and indirect tax implications, real property gains tax, capital gains tax, stamp duty, etc.);
  • Draft and review Board & Committee papers;
  • Review term sheets and agreements;
  • Assist in operationalising the approved structure;
  • Identify tax incentive opportunities and review relevant tax incentive application forms prepared by BU;
  • Draft letter to the relevant authorities (such as IRB and Ministry of Finance) for application of tax incentives / reliefs / exemption and support BU in liaising with the relevant authorities towards favourable outcome of the tax incentive / reliefs / exemption.
  • Review and assist BU in the submission of tax returns / forms (e.g. RPGT returns, Certificate of Residence)  and attend to the authorities’ queries in regards to the submission;
  • Liaise with the Group legal counsels, consultants and other professionals engaged by the Group in relation to the above.

Job Requirement

  • Must possess professional qualifications (MIT, MIA, MICPA, ACCA or equivalent) and/or Degree/Master in Accounting/Taxation or equivalent. Membership in CTIM would be an added advantage. 
  • At least 5 years of experience in tax compliance and advisory.
  • Strong knowledge of local and international tax regulations - ability to research and interpret complex tax issues.
  • Excellent analytical and problem-solving skills.
  • Detail-oriented with strong organizational abilities.
  • Proficient in Microsoft Office Suite and tax software.
  • Excellent communication skills, both written and verbal.
  • Takes initiative and able to work under minimum supervision.
